Under the Family Law Act 1975 the best interests of the children is the principle and overarching consideration. Under the Act, children also have a right to a meaningful relationship with both parents whilst being protected from harm.

With these principles in mind, we assist parents to come to parenting arrangements that are in the best interests of their children. When giving detailed advice we take into account the children’s developmental needs as well as practical considerations. Families are varied in their make up and dynamic, and what works for one family will not necessarily work for another. An analysis of routines such as school/daycare as well as extra curricula activities, ages of the children, attachment to their primary carer, as well as other factors all play a role in determining what will work well for your children to have safe and meaningful relationships with both parents.

Where there are allegations of family violence, illicit drug use, abuse of alcohol or other issues that have a devastating effect on children, we have significant resources to deal with these issues head on in order to provide a safe environment. At all times we will provide advice that is in the best interests of the children, including strategies on keeping yourself and your children safe.

We will provide frank and proactive advice, and provide you with feedback on how to maximise the children’s relationship with both parents. We will provide advice on how we think a Court would consider your matter and the type of orders that would be made. We are strongly of the view that it is best for you and your former partner/spouse to make ongoing parenting decisions for your children and not the Court, however should you need to go to Court, we can provide you with strong and effective advocacy.
